NOTICE OF PUBLIC HEARING FOR THE UPDATE TO THE CITY OF EAST HELENA SUBDIVISION REGULATIONS The East Helena Planning Board has prepared a draft update to the City of East Helena Subdivision Regulations to address changes by the legislature during the 2023 session. The City of East Helena Planning Board conducted a public hearing on the amendments on January 24, 2024 and a subsequent public meeting on March 14, 2024, and made a recommendation that the City Council adopt the amendments. A public hearing on the draft update to the City of East Helena Subdivision Regulations will be conducted at the regular meeting of the East Helena City Council on April 16, 2024, 6:30 p.m. at the East Helena City Hall, 306 East Main, East Helena, MT in the City Council room. NOTICE OF PUBLIC HEARING The City of East Helena City Council will hold a public hearing at 6:30 p.m., Tuesday, March 19, 2024, in room 110 at East Helena City Hall, 306 E. Main Street, East Helena, Montana. The purpose of the public hearing is to consider a request for annexation from Joseph Nistler to annex 5.005 acres on the north side of East Helena adjacent to Plant Road. The property is legally described as Lot 3 Hoffman Tracts Minor Subdivision located in Section 24, T. 10 N., R. 3 W, Lewis and Clark County, Montana. The City Council will hold a public hearing to gather public comment on the proposed annexation and development of the property. The City Council will make a decision on a Resolution of Intent to annex which will outline conditions that the owner must complete prior to final annexation of the property. Due to the recently passed laws on recreational marijuana, Lewis and Clark County voters passed the initiative, the text amendments are proposed to define where marijuana can be sold, manufactured, and distributed within the City of East Helena.

NOTICE OF EAST HELENA CITY COUNCIL PUBLIC HEARING FOR HIGHLAND MEADOWS MAJOR SUBDIVISION PHASE 4 COMMENCEMENT
Pursuant to the City of East Helena Subdivision Regulations, the East Helena City Council will conduct a public hearing on September 5, 2023 at 6:30 p.m. to receive public comment on the revised commencement of Phase 4 of the Highland Meadows Major Subdivision. On December 18, 2019 the City Council approved with conditions the preliminary plat of the Highland Meadows Major Subdivision. The application was approved to be developed in seven phases. The East Helena Subdivision Regulations require the applicant to notify the City upon commencement of planning and construction for each phase of the subdivision and requires the City Council to conduct a public hearing to receive public comment specific to that phase and decide whether additional conditions of approval are required to mitigate impacts for that specific phase. The applicant had previously notified the City on September 14, 2022 that they are commencing planning for Phase 4 of Highland Meadows Major Subdivision and on October 18, 2022 the Council held a public hearing and approved the commencement of Phase 4. The applicant has requested an amendment to the Phase 4 commencement to include the remaining 60 lots for a total of 123 single family residential lots, internal water and sewer improvements to serve each lot, storm water conveyance and detention, and improvements to Meadow View Loop, Stirling Loop Court, Argyll Court, and Glenco Court.

NOTICE IS HEREBY GIVEN that on August 17, 2021, the City Council (the “Council”) of the City of East Helena, Montana (the “City”) adopted a Resolution of Intention of the City of East Helena, Montana to Increase Rates for the Users of the Municipal Water System.
The City utilizes an equivalent dwelling unit methodology for imposing rates and charges, which is based on the size of the water line or meter servicing each connection. A 3/4 inch or 5/8 inch service, which is the standard service for single family residential users, is 1 Equivalent Dwelling Unit (EDU).

In addition, the City will increase the Varied Rate to $1.35 per l,000 gallons of water or portion thereof used per user per month (the “Proposed Varied Rate”).
Commencing with the January 2022 billing, the City will charge all users connected to the water system the sum of the Proposed Base Rate Charge plus the Proposed Varied Rate.
The City will also increase the Irrigation Hydrant Surcharge to $28.85 per month for the months of May through October.
For a residential user with a ¾ inch line using 3,000 gallons of water per month, the proposed monthly charge ($43.25 + $4.05 = $47.30) represents an increase of approximately 42% over the current monthly charge ($30.00 + $3.30 = $33.30). For a user with an unmetered irrigation hydrant, the proposed Irrigation Hydrant Surcharge represents an increase of approximately 44.25% over the current Irrigation Hydrant Surcharge.
Public meetings and Public hearings were held in 2019, 2020, and 2021 culminating in a public hearing on the proposed rate increase on September 7, 2021, and a final Public Hearing on Tuesday, October 5, 2021.
